Nautilus, Inc., and our subsidiaries and affiliates (collectively, “Nautilus,” “we” or “us”), takes the protection and proper use of your information seriously.

This Privacy Policy describes how we collect and use personal information about you when you call us on the phone, visit our family of websites (including NautilusInc.com, Nautilus.com, Bowflex.com, Bowflex.ca, SchwinnFitness.com, ModMov.com, NautilusInternational.com, Global.Bowflex.com, Global.Nautilus.com, Global.Modmov.com, and Global.SchwinnFitness.com ) (the “Sites”), use our equipment interfaces, mobile and desktop or device applications (including Bowflex SelectTech, Bowflex Max Trainer, Bowflex Results, Bowflex TreadClimber, Bowflex HVT, Bowflex Toolbox, Nautilus Trainer 2, Bowflex LateralX, Schwinn Toolbox, Schwinn Trainer, Schwinn Classic Cruiser, and Max Intelligence) and certain Nautilus controlled social media pages (including on Facebook, Instagram, Spotify and Twitter) (collectively the “Service”).

WHAT PERSONAL INFORMATION DO WE GATHER?

Here are the general types of information we gather:

INFORMATION YOU GIVE US

We receive and store any information you provide to us when you complete surveys, request additional information from us, participate in a sweepstakes or other incentives, post information on the Service, make purchases online, set up accounts, sign up to receive our newsletters or other e-mail communications, communicate by e-mail, communicate with us through a social media platform (for example Facebook, Twitter, Pinterest, Instagram), communicate with us by telephone or physical mail with our customer service, use our services or products, or otherwise interact with us. Such information may include your name, address, e-mail address, shopping interests and preferences, transaction history and other personal data. To help improve your experience or enable certain features of the Service, you may choose to provide us with additional information such as weight, age, or logs for sleep, food or exercise. You can choose not to provide certain information, but then you might not be able to participate in our surveys or incentives, purchase products, or take advantage of certain features of the Service.

If you engage with us through a social media platform those communications are governed by this Privacy Policy as well as the policy of the relevant social media platform.

You may choose to provide us names or other contact information for a friend to take advantage of a referral or other program, to send them product information or gifts, or to utilize a social feature of the Service. Subject to restrictions imposed under applicable laws and unless otherwise specified when you provide us the information, the information we collect about you and your friend may be stored and used in the ways described in this Privacy Policy.

We value your reviews, comments, feedback, testimonials, etc., which help us improve our services and products. By making such submissions to us, you assign your rights in the submissions to us as described in the "Submissions" section of our Terms of Use page.

INFORMATION RECEIVED FROM YOUR USE OF OUR SERVICE

We and our business partners receive and store certain types of information whenever you interact with us. For example, like many Web sites, we use technologies such as "cookies" and "clear gifs" to obtain certain types of information when your Web browser accesses one of our Sites, or when you are provided the opportunity to complete surveys, participate in a sweepstakes or other incentives, or open or respond to any newsletter or other e-mail. Briefly, "cookies" are small files that we transfer to your computer's hard drive or your Web browser memory to enable our systems to recognize your browser and to provide convenience and other features to you, such as recognizing you as an existing customer or previous Site visitor. "Clear gifs" are tiny graphics with a unique identifier, similar in function to cookies, and may be used to track the online movements of Web users or to let us know if you have opened an e-mail that we sent you.

Examples of the information we collect and analyze in this manner include the Internet Protocol (IP) address used to connect your computer to the Internet; computer and connection information such as browser type and version, operating system, and platform; your behavior on the Sites and related services, including the products you view or searched for, as well as the URL you come from and go to next (whether this URL is on the Sites or not).

You are always free to decline our cookies if your browser permits, although in that case you may not be able to use certain features on, and significant portions of, the Sites. Also, because information we obtain may be combined, we may still be able to identify your web browser, computer or mobile device when you access the Service even if you disable cookies. Some browsers incorporate a “Do Not Track” (DNT) feature that, when turned on, signals to websites and online services that you do not wish to be tracked. Because there is not yet an accepted standard for how to respond to browser DNT signals, we do not currently respond to them. Please keep in mind that your web browser may not permit you to block the use of these non-cookie technologies, and those browser settings that block cookies may have no effect on such techniques.

Nautilus exercise equipment interfaces may collect data such as speed, heart rate, distance traveled, active minutes or calories burned. Data collected varies depending on which equipment you use.

Device information, and data such as location and health statistics may be collected through your personal devices (such as phones or fitness trackers), and we may collect such information when you download or use our applications or synch your device with the Service.

Data collected through your exercise equipment interfaces or your devices may be transferred from your equipment interface or device to our servers or otherwise consistent with this Privacy Policy.

HOW WE USE AND SHARE PERSONAL INFORMATION

GENERAL USE

We use your personal information to conduct our business and to provide you with and improve the Service. For example, we may use your personal information for such purposes as customizing future shopping and savings opportunities for you, confirming and tracking your orders, understanding our customer demographics and preferences, improving your workout experience, and communicating with you.

We also may combine any or all of the information that we collect or obtain.

THIRD PARTY MARKETERS AND OTHER BUSINESS PARTNERS

From time to time, we make our mailing list and general shopping activity available to carefully screened companies whose products or services we believe will be of interest to you.

Our business partners may use cookies on our Sites for the same general purposes identified in this Privacy Policy, including to improve their own marketing, products or services. Third parties may use cookies and other technologies to collect information about your online activities over time and across different websites. Companies that we share information with, including ad networks, may use the information we provide to them, often in combination with their existing information, to provide you with more relevant advertising, and to help us and third parties do the same. AGGREGATED AND ANONYMIZED DATA

We may use and disclose, and authorize third parties to use and disclose, non-personally identifiable information at our discretion.

SERVICE PROVIDERS

From time to time, we employ other companies and individuals to perform various functions on our behalf. Examples include fulfilling orders, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing credit card payments, and providing customer service.

ONLINE FINANCING

If you apply for credit through the Service, your personal information may be shared with a credit agency(ies) and other parties as necessary for our business purposes in connection with such credit application. All credit decisions are subject to the policies set forth in the credit application.

SPECIAL EVENTS

If you choose to participate in a special event (for example, a promotion, contest, or sweepstakes), we may share your information with those organizations participating in the applicable event.

THE NAUTILUS FAMILY OF BRANDS AND COMPANIES

We share much of our data, including personal information about you, with our affiliated entities and joint ventures when it is reasonably necessary for the purposes otherwise permitted in this Privacy Policy.

BUSINESS TRANSACTIONS

Your information may be disclosed as part of any merger, sale of company assets or acquisition, as well as in the event of an insolvency, bankruptcy or receivership. WHAT CHOICES DO I HAVE?

As discussed above, you can always choose not to provide information, although that might prevent us from personalizing the Service for you or may prevent you from participating in a survey or sweepstakes or taking advantage of certain useful features of the Service. We will retain in our files information you have requested to delete in some circumstances, such as to resolve disputes, troubleshoot problems and enforce our Terms of Use. Furthermore, such prior information is never completely removed from our databases due to technical and legal constraints, including stored "back up" systems.

A SPECIAL NOTE ABOUT CHILDREN

The Service is not designed or intended for use by children under 14. If you are under 18, you should use the Service only with involvement of a parent or guardian. Children under 14 may not submit any personally identifiable information to us, and if we discover that we have inadvertently gathered any such information from a child under 14, we will take appropriate steps to delete it. YOUR CALIFORNIA PRIVACY RIGHTS

If you are a California resident and would like a copy of our notice describing what categories of personal information we share with third parties or corporate affiliates for their direct marketing purposes and the names and addresses of the third parties and affiliates that received your information in the past year, please submit a written request to the following address: Nautilus, Inc. USERS OUTSIDE OF THE UNITED STATES

If you are a user of the Service outside of the United States, by using the Service and/or providing us with information, you acknowledge and agree that your personal information may be processed for the purposes identified in the Privacy Policy. In addition, your personal information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of personal information may be less stringent than the laws in your country, and where governments, courts or law enforcement or regulatory agencies in those other countries may be able to obtain disclosure of that personal information through the laws of those countries. UPDATES TO THIS PRIVACY POLICY

As this Privacy Policy may be modified from time-to-time, you should check this Privacy Policy frequently for any such changes. When we make material changes to this Privacy Policy, we will notify you by posting the updated Privacy Policy on our website, and we will update the effective date at the end of this Privacy Policy. Our use of information gathered or obtained at any time is subject to the Privacy Policy in effect at the time of such use, as permitted by law.

LINKS TO THIRD PARTIES; THIRD PARTY SYNCHING

The Service may provide links to other Internet sites, content or videos (embedded or direct links) maintained by third parties. We are not responsible for the sites, content, or videos accessed via the links, and we have not reviewed the privacy practices of those third parties. We encourage you to review the privacy practices of those third parties.

In addition you may be able to sync, or allow a third party to sync, certain Nautilus equipment with third party applications or software in order to share data collected on the equipment with such third party. We are not responsible for such third parties' use of your shared data. We encourage you to review the privacy practices of those third parties before allowing them to synch with your equipment.

TERMS APPLICABLE TO DATA FROM EU MEMBER COUNTRIES

We are based in the United States. In most cases, the personal information we collect is stored and used in the United States.

If we collect personal information from EU residents in a manner subject to the European Union’s General Data Protection Regulation (“GDPR”) then, in addition to the above, the following terms shall also apply to our collection, use and retention of that information:

Basis for Collection. As set out above, we collect and process personal information for which you have given your express consent. We also collect and process personal information in order to improve our services, to deliver services and perform obligations under contracts we have with you, and to comply with our own legal obligations.

HEALTH AND OTHER SPECIAL CATEGORIES OF PERSONAL DATA. To the extent that information we collect is health data or another special category of personal data subject to the GDPR, we ask for your explicit consent to process such data. We obtain this consent separately when you take actions leading to our obtaining such data, for example, when you download one of our applications. You can withdraw your consent at any time, including by removing our access to a third-party service, unpairing your device, using your account settings or tools, or emailing us at privacy@nautilus.com.

Onward Transfer. Except as otherwise provided in this Privacy Policy, we only disclose personal information to third parties who reasonably need to have access to it for the purpose of the transaction or activity for which it was originally collected or to provide services to or perform tasks on our behalf or under our instruction. All such third parties must agree to use such personal information we provide to them only for the purposes for which we have engaged them and they must either: (a) comply with the EU-US Privacy Shield Principles or another mechanism permitted by the applicable EU & Swiss data protection law(s) for transfers and processing of personal information; or (b) agree to provide adequate protections for the personal information that are no less protective than those set out in this Privacy Policy.
